General Terms and Conditions
The GADOW network is a platform through which individuals, companies, organisations and institutes can network with one another to build up contacts and exchange information.
Registration is required in order to access the GADOW network and its services. By registering to join the GADOW network and use the website, you accept our General Terms and Conditions (hereafter referred to as “GTC”) and agree to enter into a legally binding contract with the GADOW network. The contract comes into force once your profile has been checked by the GADOW network. On entering into this contract, you become a user (hereafter referred to as the “User”) of our services.
The contractual relationship between the User and the GADOW network (hereafter referred to as the “Operator”) are laid down in these GTC. The User can access and print out these GTC at any time by following the “GTC” link on our website.
On its platform, the Operator offers the user various services designed to bring users together. The User may create a profile that stores information about his/her person, company, organisation or institute for the purpose of presenting him/herself to other users.
The Operator shall not be liable for establishing contact with particular users or other third parties. The Operator does not assume any liability for any contracts of any kind concluded between users. The Operator does not provide any guarantee that the content of saved user profiles or any other information and data relating to the users is true, nor does he assume any liability for the content of external links.
The Operator is entitled to remove any content, data or information that does not comply with these GTC, or that violates legal provisions or moral standards, without prior notice.
The Operator reserves all rights relating to the intellectual property of the platform http:// www.gadow-offshore.net, as well as all texts and services. Any other use in any other form requires the prior written approval of the Operator.
By accepting the GTC, the User confirms that he/she is aged 18 years or over. The User is not permitted to set up more than one profile. The User may only create profiles in connection with his/her person, company, organisation or institute.
The Operator assumes no liability for the accuracy and truthfulness or legality of information or content provided by the User. The User accepts sole responsibility for ensuring that links to external websites that the User has entered in his/her profile do not refer to third-party content that violates applicable law.
The profile must be a true reflection of the actual circumstances of the company, organisation, institute or person. For this reason, the User is required to provide the Operator with his/her current personal data and to keep his/her profile up-to-date.
The User him/herself is responsible for the content and legality of all profile data, as well as information that he/she makes available to other members.
The Operator assumes no responsibility for the misuse or illegal distribution and use of content provided by the User.
The User agrees to the permanent storage of his/her profile and relating data.
The User undertakes to assume and exempt the Operator from any claims for damages and costs resulting from third-party legal action or allegations arising as a result of a breach of these GTC or applicable law by the User.
The Operator reserves the right to exclude users from its platform without stating reasons for doing so.
The operator assumes no liability and provides no guarantee for the continuous availability of its services. Any liability for malfunctions due to use of inadequate hardware or software, interruptions to online data transfers, or any other reason, is also excluded. The Operator also reserves the right to change, remove or expand elements of the general design of its services, as well as specific functions, at any time.
Regardless of the legal reason, the Operator shall only be liable for claims for damages that result from deliberate or grossly negligent behaviour by the Operator or his representative in breach of its main contractual duties. Liability shall only be assumed for damage or loss that neither results from deliberate nor grossly negligent behaviour if obligations that are of special significance to the fulfilment of the contract are violated. Generally, the sum of claims for damages is limited to that of typical, foreseeable damages.
Liability in the case of claims for personal injury or material damage pursuant to the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
The User exempts the Operator from all claims for damages or other claims asserted against the Operator by other users or third-parties that result from a violation of rights by content published by the User in the GADOW network. This shall include claims for damages asserted against the Operator by other users or third parties on the basis of rights violated through use of the operator’s services by the User. The User assumes all costs incurred in this regard.
7. Data protection
The protection of User data is very important to the Operator. This is why it has laid down data protection provisions that offer the highest possible level of protection for the users. The Operator adheres to all the applicable data protection guidelines. The Observer will never pass on or disclose personal data relating to the users to third parties without permission to do so.
8. Final provisions
The Operator reserves the right to amend, extend or replace these GTC, without stating reasons for doing so, and publish them on the website www.gadow-offshore.net. If the User does not object to the changes made to the GTC within four weeks, it is assumed that the User accepts the new GTC. The contract and any amendments to it must be made in writing.
Should any individual provisions of these GTC prove to be unlawful, ineffective or unenforceable, this shall not affect the other provisions of these GTC. The Operator reserves all rights that are not explicitly granted under these GTC, including all property rights and rights of use, intellectual property rights and all other rights to this platform, its services and newsletters.
The sole place of jurisdiction and place of performance is Kiel, Germany. German law applies.
In the event of any possible disagreement, please contact the Operator first before rushing into legal action. A lot can be achieved to the satisfaction of all those involved through constructive, open communication.
